Collaborative Law

It is not necessary to engage in an ugly court battle during your divorce process. Rather, you and your spouse can agree to take a collaborative approach to your divorce and commit to staying out of the courtroom. The attorneys at Bloch & Whitehouse, P.A., are members of the Collaborative Law Institute and are here to assist you in taking an alternative approach to building a positive future for you and your children.

Maintain Dignity and Respect for Yourself and Your Family Through the Divorce Process

Parties who choose to follow the collaborative model for their divorce, sign a participation agreement at the outset of the proceedings that sets forth the ground rules for the process. The participation agreement provides for the following:

  • That the parties will fully and freely disclose information and documentation during the divorce process so that both parties can make informed decisions about their futures.
  • That the parties will maintain confidentiality during the divorce process so that both parties can feel free to discuss all issues without repercussions.
  • That neither party will initiate court proceedings so that both parties and their children can be free from the mudslinging and degradation often associated with the adversarial court process

Parties meet with their collaborative attorneys to discuss individual needs and concerns early in the process. Subsequently, a full and final settlement is reached through a series of settlement conferences with both parties and their respective attorneys. All the while, the parties and their lawyers proceed through the divorce process with dignity and respect with the goal of crafting a settlement that addresses both parties’ legal, financial and emotional needs.
